NCAA Name, Image, and Likeness Deals

With the various NCAA championship tournaments currently underway, the KCA has received phone calls about NIL (Name, Image, and Likeness) deals for college athletes.

NIL deals present a unique opportunity to connect with and support local athletes while boosting your practice’s visibility. However, navigating NIL deals requires careful consideration. Here are some of the things you should keep in mind.

The rise of Name, Image, and Likeness (NIL) deals has dramatically reshaped the landscape of college athletics. For chiropractors, this presents a unique opportunity to connect with and support local athletes while boosting their practice’s visibility. However, navigating NIL deals requires careful consideration. 

NIL rules vary by state and even by individual university. Chiropractors must thoroughly research the specific regulations governing their target athletes to ensure compliance.   

The NCAA’s rules are constantly evolving, so staying current is crucial. Kansas currently has no laws regarding NIL deals. You would be held to NCAA and University standards. 

A NIL agreement should outline the services provided in exchange for the athlete’s endorsement. This could include regular chiropractic adjustments, sports injury rehabilitation, nutritional counseling, social media promotions, and public appearances.

An agreement should define the duration of the agreement and the specific deliverables expected from both parties.

Even with a NIL agreement, your office is still held to the same standards of patient privacy and HIPAA. Obtain explicit consent from the athlete before sharing any health-related information.

An attorney should draft contractual agreements, such as NIL deals, specific to your office and the athlete you will be working with. You should not just copy and paste another office’s contract.

You must be aware of potential conflicts of interest, especially if the athlete receives treatment from other healthcare providers. Maintaining open communication with the athlete’s athletic trainers and team physicians is essential.

By carefully considering these factors, chiropractors can leverage NIL deals to build successful partnerships with college athletes while also providing valuable healthcare services.

Kansas Mandatory Reporter Laws


KCA has added an update on Kansas’ Mandatory Reporter Laws to the State and Federal Regulations page on www.kansaschiro.com
Kansas has two statutes that relate to mandatory reporting:
1.  Child Abuse and Neglect
2.  Infectious or Contagious Diseases and Conditions.

Doctors of Chiropractic in Kansas are licensed to practice the healing arts and, as such, are held to the reporting standards for both child abuse and neglect and contagious diseases and conditions.
