Credit Card Surcharge Fees
We continue to receive calls concerning credit card surcharge fees. During the 2024 session, the Kansas legislature passed a bill that allows all merchants to add up to a 4% credit card surcharge to credit transactions. This bill went into effect on January 1, 2025.
There are several things to consider when deciding whether or not to implement a credit card surcharge fee.
- Medicare does not allow healthcare providers to pass on the cost of doing business to its beneficiaries. This means that if you see Medicare patients, you cannot add a credit card surcharge to their credit card payments.
- Many other insurance contracts will have similar prohibitions or may not allow you to collect more than the allowed amount from a patient. You must review every contract you have before deciding to implement a credit card surcharge fee.
- Surcharge fees cannot exceed 4% and must be related to the actual cost of accepting credit cards.
- Surcharge fees can only be applied to credit card transactions. You cannot apply them to debit cards, even if ran as a credit card.
- Surcharge fees cannot be applied to payments from FSA (flexible savings accounts) or HSA (health savings accounts).
If you decide to implement a credit card surcharge fee, you must:
- Notify major credit card institutions in writing about your intent to surcharge.
- Patients should be clearly informed about any surcharges prior to payment on both invoices and clear signage in your office.
- Calculate the average cost to accept credit cards in your office, and do not exceed that amount with your surcharge.
- List surcharges as a separate line item on your invoices.
- Ensure you maintain PCI (payment card industry) compliance to secure credit card transactions and protect against data breaches.
